Criminal Law Enforcement, Illegal Timber Trade, Environmental ManagementAbstrak
This study aims to understand how criminal law is enforced against the illegal timber trade in environmental management in Barru Regency, and how this enforcement contributes to environmental governance in the region. The research was conducted in Barru Regency, using data collection techniques including observation, interviews with the Barru Regency Forestry Department and local communities, as well as literature studies by reading and quoting both directly and indirectly from relevant literature and laws related to the research variables. The data analysis method used in this study is qualitative descriptive analysis. The findings of this study include: 1) Criminal law enforcement against perpetrators of the illegal timber trade in Barru Regency refers to Law Number 41 of 1999 concerning Forestry, Law Number 32 of 2009 concerning Environmental Protection and Management, and Barru Regency Regional Regulation Number 06 of 2023. Efforts to enforce the law against forest destruction are carried out in two ways: prevention (preventive) and control (repressive). 2) The effectiveness of sanctions imposed on perpetrators of the illegal timber trade in Barru Regency remains questionable, as the penalties often do not match the extent of damage caused by such illegal activities. Although some cases have been prosecuted successfully, many perpetrators continue to operate without fear of legal consequences. To improve the effectiveness of sanctions, consistent and firm law enforcement is necessary, along with enhanced cooperation among the government, local communities, and non-governmental organizations to monitor and report illegal activities.
