REKONSTRUKSI PERAN REAKTIF BPOM TERHADAP PENGAWASAN OVERCLAIM PRODUK SKINCARE

This study aims to determine the effectiveness and ideal model of the role of the Food and Drug Supervisory Agency in the supervision of overclaims of skincare products circulating in Indonesia. The research method used is a normative research method with a legislative approach and a conceptual approach. The results of the study show that the effectiveness of BPOM supervision on Skincare Product Overclaims is still reactive, with a reliance on community reports and limited inspections. Existing regulations have not specifically regulated the standard of scientific proof of product claims. In addition, the post-market surveillance carried out has not been able to prevent the spread of products with overclaims, so there are still many products on the market that are not in accordance with the information provided to consumers. The Ideal Model of BPOM Supervision in monitoring overclaims of skincare products is a proactive supervision model, reconstructing the role of BPOM through strengthening the pre-market approval mechanism with stricter scientific validation, increasing post-market surveillance with routine inspections and laboratory tests, and revising regulations to clarify the standards of scientific evidence that must be met by manufacturers before product claims are approved.
