Abstract

This study aims to examine the legal protection of contract workers in the employment system. The employment system in Indonesia has undergone significant changes with the increase in the practice of fixed-term employment contracts (PKWT). Although intended to provide flexibility for the business world, its implementation has raised legal issues related to worker protection. This study aims to analyze the weaknesses of PKWT regulations in ensuring legal certainty and fairness for contract workers. The method used is normative legal research with a legislative and conceptual approach, utilizing primary and secondary legal sources, and analyzed qualitatively using a descriptive-analytical method. The results of the study indicate that the PKWT regulations still leave a number of issues unresolved, such as ambiguous norms, uncertainty regarding employment status, and weak sanctions for violations, which substantially contradict the principles of justice, legal certainty, and the protection of workers' rights. A more comprehensive reformulation of regulations and strengthened enforcement of the law are needed to ensure that the rights of contract workers are protected fairly and proportionally. Thus, Indonesia's labor system can move toward a more just and sustainable order.
